Section 39
Deemed to have committed an offense
If anyone commits or causes the following acts, he shall be deemed to have committed an offense under this Act:-
(a) Artificial or false transactions or circular trading (circular trading) or for the purpose of influencing the price of any commodity contract by hoarding a large quantity for an unnatural period of time so that others cannot enter into such a contract by stabilizing, increasing, decreasing or repeatedly changing the price of the commodity. If it fluctuates,
(b) If he affects the commodity exchange market by increasing, reducing or stabilizing the market price of the commodity contract obtained by himself or with others for the purpose of directly or indirectly influencing the transaction or preventing the purchase or sale of the commodity contract,
(c) publishes false, misleading or incorrect information or preconceived information or makes promises by giving such information or transacts only to show that an item is being actively traded in the barter market or maliciously conceals any fact or information;
(d) In case of using fraudulent technology to cause harm to someone or to take unfair advantage from someone, or if he misuses technology with such intention, plans or does any work or engages in fraudulent transactions by deceiving someone,
(e) If any person destroys, falsifies or conceals any document, statement or record kept in accordance with this Act or the rules or regulations made under this Act,
(f) If the licensed organization damages or misuses the electronic transaction system established in accordance with section 44 with the intention of causing harm to anyone,
(g) In case of helping or abetting anyone to commit the acts of clauses (a) to (f).
